1. General Information
bel etage Kunsthandel GmbH specialises in original antiques, historical design objects, and works of art, with a particular focus on Viennese design and decorative arts of the 20th century.
All objects offered through our online shop are carefully selected and examined with regard to their authenticity, origin, artistic significance, and condition. Please note that the objects offered are historical pieces and may therefore show signs of age, use, and natural wear. Such characteristics are inherent to antique objects and form part of their individual history.
We make every effort to ensure that all descriptions, photographs, and information provided on our website are accurate. However, slight variations in colour and appearance may occur due to digital photography, lighting, and individual screen settings. Age-related characteristics and signs of wear that have been accurately described or disclosed do not in themselves constitute defects. Statutory warranty rights remain unaffected.

3. Prices and Payment
All prices are stated in Euros (EUR).
The total purchase price and shipping costs is displayed during the ordering process before the order is placed. For larger objects, furniture, or particularly delicate items requiring individual packaging and specialist transport, shipping costs may be quoted separately and agreed upon before the purchase is finalised.
We accept PayPal, EPS online banking, and major credit and debit cards, including Visa, Mastercard, and American Express.
For deliveries outside the European Union, additional customs duties, import taxes, or handling fees may apply. These charges are the responsibility of the buyer unless otherwise expressly agreed.
4. Packaging, Shipping and Delivery
Every object is carefully prepared for transport, taking into account its age, materials, dimensions, and fragility.
Whenever possible, we use recycled packaging materials. Particularly delicate objects, larger items, and furniture may require individually designed packaging or specialist transport arrangements.
We work with reliable shipping providers, including DHL and Austrian Post. For furniture and larger objects, we arrange transport through specialised freight carriers where appropriate.
All shipments are arranged with appropriate insurance coverage.
Delivery times depend on the destination, the shipping provider, and the nature of the object.
Estimated delivery times after dispatch are:

These timeframes are estimates. Any binding delivery arrangements and applicable statutory delivery rights remain unaffected.
For particularly valuable, fragile, or large objects, including furniture and antique glassware, individual shipping arrangements may be necessary. Such arrangements will be communicated to the customer in advance and do not affect any mandatory statutory consumer rights, including the right of withdrawal where applicable.
5. Right of Withdrawal and Returns
5.1 Statutory Right of Withdrawal
Consumers purchasing through our online shop generally have the right to withdraw from their purchase within 14 days without giving a reason, in accordance with the Austrian Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz — FAGG).
The withdrawal period begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, receives the goods. Special rules apply where an order is delivered in multiple shipments.
To exercise the right of withdrawal, the consumer must inform bel etage of their decision by an unequivocal statement, for example by email or post.

To meet the withdrawal deadline, it is sufficient to send the withdrawal notification before the 14-day period expires.
5.2 Return of Objects
Following withdrawal, the consumer must return the object without undue delay and no later than 14 days after communicating their decision to withdraw.
The direct costs of returning the goods are borne by the consumer, subject to the applicable statutory information requirements.
As many of our objects are rare, valuable, and delicate, we recommend contacting us before arranging a return so that suitable packaging and transport arrangements can be discussed.
Objects must be packaged carefully to ensure appropriate protection during transport. For particularly fragile or valuable items, including antique glassware, we strongly recommend professional packaging and insured shipping.
We are happy to assist customers in arranging appropriate return transport upon request.
Returns may also be made in person at our gallery in Vienna by prior arrangement.
5.3 Refunds
In the event of a valid withdrawal, bel etage will reimburse all payments received from the consumer, including standard delivery charges, in accordance with statutory requirements.
Additional costs resulting from the consumer's choice of a delivery method other than the least expensive standard delivery offered by bel etage are not reimbursable.
Reimbursement will be made without undue delay and no later than 14 days after bel etage has been informed of the consumer's decision to withdraw.
We may withhold reimbursement until we have received the returned goods or the consumer has supplied evidence of having sent them back, whichever occurs first.
Refunds will be issued using the same payment method used for the original transaction unless expressly agreed otherwise. No fees will be charged for the reimbursement.
5.4 Condition of Returned Objects
The consumer is responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning, subject to applicable law.
Due to the historical and often irreplaceable nature of our objects, particular care should be taken when handling, packaging, and returning them.
5.5 Exchanges and Voluntary Returns
As every object offered by bel etage is unique, we do not offer voluntary exchanges or returns beyond statutory requirements.
This does not affect the statutory right of withdrawal or any applicable warranty rights.
5.6 Individually Arranged Shipping
Certain objects, particularly furniture, large items, and exceptionally fragile or valuable pieces, may require shipping arrangements agreed individually with the customer.
The conditions and costs of such arrangements will be communicated before the purchase is finalised.
Individually arranged shipping does not, in itself, exclude the statutory right of withdrawal.
5.7 Exceptions
The statutory right of withdrawal does not apply where an exception expressly provided for by applicable law is met. The statutory consumer right of withdrawal does not apply to purchases made by business customers.
6. Warranty and Authenticity
Authenticity, quality, and historical significance are fundamental to the philosophy of bel etage.
Each object is carefully selected and examined by Wolfgang Bauer, the gallery's founder and a specialist in Viennese design and decorative arts of the 20th century.
With decades of experience and extensive knowledge of the field, bel etage stands behind the authenticity and originality of the objects offered for sale.
Each purchased object is accompanied by a certificate of authenticity issued by the gallery.
As antique and historical objects, the items offered may show age-related characteristics, previous restorations, or signs of use. These characteristics are taken into account in the descriptions and condition assessments of individual objects.
Any characteristics, restorations, or signs of wear that have been accurately described or expressly disclosed are considered when assessing whether an object conforms to the agreed description and condition.
The statutory warranty provisions under applicable Austrian law remain in effect.
Nothing in these Terms & Conditions excludes or restricts mandatory statutory consumer warranty rights. If an object arrives damaged or does not correspond to its description, customers are kindly requested to contact us at shop@beletage.com.
7. Applicable Law and Jurisdiction
These Terms & Conditions are governed by Austrian law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law does not deprive them of the protection afforded by mandatory provisions of the law of their country of habitual residence, where applicable.
For disputes involving consumers, jurisdiction shall be determined in accordance with the applicable statutory provisions.
For transactions between businesses, the competent court in Vienna, Austria, shall have jurisdiction to the extent legally permissible.
8. Data Protection
We treat all personal information confidentially and process personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR).
Personal data provided in connection with an order is processed for the purpose of handling purchases, payments, deliveries, and related customer communications, as well as fulfilling applicable legal obligations.
Where customers subscribe to our newsletter, their email address will be used for marketing communications in accordance with applicable legal requirements and on the basis of consent where required.
Newsletter subscriptions may be cancelled at any time.
